Equipment: Motion-platform Simulators, Direct Drive Wheelbases, VR/Triple Monitor Arrays

1. Assumption of Risk

I, the undersigned, acknowledge and understand that using high-performance simulation equipment involves certain inherent risks, including but not limited to:

• Physical Forces: High-torque direct drive wheels (Force Feedback) and motion platforms can produce sudden, powerful, and violent movements.

• Sensory Effects: Use of high-refresh-rate monitors (LG 45" OLEDs) or VR headsets may cause vertigo, motion sickness, nausea, or disorientation.

• Physical Strain: Participation may cause muscle strain, joint soreness, or fatigue.

• Home Environment: I acknowledge that the Test Studio is located within a private residence and I agree to remain within the designated studio area

2. Health & Competency Representation

I represent that I am in good physical health and do not have pre-existing conditions (e.g., heart conditions, back/neck injuries, or epilepsy) that could be aggravated by this activity. Furthermore, I represent that I have a baseline familiarity with sim racing hardware and understand the mechanical forces involved. I agree to notify Simwerks personnel immediately if I feel uncomfortable or if the equipment appears to be malfunctioning.

3. Waiver and Release of Liability

In consideration of being allowed to test the Simwerks equipment, I hereby release, waive, and discharge Simwerks LLC, its members, and John J. Fryman and family (collectively "the Releasees"), from any and all liability, claims, or demands for personal injury, death, or property damage arising out of or related to my presence on the property or my use of the simulation equipment, whether caused by the negligence of the Releasees or otherwise.

4. Premises Indemnification

I acknowledge that I am a guest on private residential property. I agree to indemnify and hold harmless the Releasees from any loss, liability, or cost—including legal fees—incurred due to my presence including but not limited to slips, falls, or injuries occurring in the driveway, walkway, or interior of the residence.

5. Equipment Stewardship & Financial Responsibility

I agree to treat all equipment with the utmost respect. This includes following all "Emergency Stop" procedures and "House Rules" (e.g., no food/drink near rigs). I agree to be held personally and financially responsible for the full repair or replacement cost of any equipment (monitors, PCs, chassis, etc.) damaged through gross negligence, "rage" incidents, or intentional misuse.

6. Media and Privacy Policy

Simwerks encourages photography and videography of the simulation equipment for social sharing. However, to protect the privacy and security of the residence:

• Studio-Only Content: Photography and videography are strictly limited to the designated Studio space. No images or videos of the home's exterior, driveway, or non-studio interior areas are permitted.

• Location Privacy: Participant agrees not to tag or disclose the specific residential street address on any public social media platforms or check-in services.

• Proprietary Setup: Participant agrees not to disclose specific internal business strategies or "behind-the-scenes" proprietary configurations discussed during the session.
