Thank you for choosing Simwerks LLC ("Simwerks," "we," "us," or "our"). This Warranty and Support Policy outlines the terms governing retail equipment sales, custom affiliate builds, and hardware installations handled through our website (www.simwerkspitt.com) or custom client orders.

By purchasing equipment or commissioning a hardware installation from Simwerks, you acknowledge and agree to the following terms regarding hardware warranties and ongoing technical support.

1. Manufacturer's Express Warranty Only

All high-performance simulation hardware, computers, components, and accessories sold or distributed by Simwerks are manufactured by independent third-party entities.

Simwerks LLC provides NO express or implied warranties of any kind regarding the equipment, including any implied warranty of merchantability or fitness for a particular purpose. All hardware warranties are provided exclusively by the original equipment manufacturer. Any equipment defects, component failures, or technical malfunctions that arise after delivery must be handled directly through the respective manufacturer’s standard warranty claims process.

2. Limit of Simwerks Responsibility (Correct Delivery Clause)

The sole responsibility of Simwerks regarding retail sales and affiliate builds is to ensure that the ordered hardware is delivered to the customer in its entirety and in initial working order.

Our liability terminates completely upon the successful delivery of the product (or completion of the initial turnkey installation process, if an affiliate build service was purchased). Once the system is verified operational at delivery, Simwerks bears no further responsibility or liability for subsequent wear-and-tear, configuration changes, firmware updates, hardware failure, or software compatibility issues.

3. Customer Support and Troubleshooting

Because we deal in complex, high-fidelity enthusiast hardware, technical troubleshooting can vary wildly based on user software environments, games, and user-end calibration.

Simwerks does not provide ongoing technical support, software troubleshooting, or hardware repair services. If you experience performance issues, connection drops, or calibration errors, you must contact the original equipment manufacturer or software provider for specialized technical support.

4. Exclusions from Support and Liability

Under no circumstances shall Simwerks LLC be held liable or responsible for:

* Hardware components damaged due to improper user configuration, unapproved firmware modifications, or aggressive direct-drive force feedback settings.

* Damage resulting from user negligence, power surges, or physical misuse (e.g., "rage" incidents).

* Incompatibilities arising from third-party software updates, operating system patches, or sim racing game updates.

5. Limitation of Financial Liability

To the maximum extent permitted by applicable law, in no event shall Simwerks LLC be liable for any indirect, incidental, special, consequential, or punitive damages—including but not limited to loss of enjoyment, downtime, or missed competitive event windows—resulting from equipment malfunctions or manufacturer delays in processing a warranty repair.
